THE LEGAL PROCESS FOR THE PURCHASE OF A PROPERTY

Phase 1: Private purchase/sale contract:

Once the property that complies with all the requirements of the Purchasers has been chosen and following an agreement between both parties, a private purchase/sale contract will be signed, having obtained beforehand a NOTA SIMPLE, where it will be verified that the owners are on fact the legal owners and that there are no charges or debts on the property.

Upon the signing of the contract a deposit of 10% of the purchase Price will be required to make the contract firm.

Phase 2: The signing of the Escritura Publica (Deeds).

On the day agreed on the private contract, the siging of the deeds will go ahead. At this time the amount outstanding of the purchase price will be paid (less the 10% deposit already paid), and the taxes and expenses paid (approximately 2% Notary's fees and Land Registry 8% for the transmission of the property). In the same way, the 3% of the sale price will be retained, if they are non-residents.

Once the Escritura (Deed) is signed by all parties (Notary, Vendors and purchasers). The Notary will present a copy of the Escritura (Deed) to the tax office and the original to the Land Registry, and the name of the new owners will be incorporated on The Escritura of the property.
